Landlord-Tenant Law
This is a part of common law that deals with the relationship between the landlord and the tenant.
Landlord-tenant law tends to articulate the various rights and responsibilities the landlord and
tenant have with regard to the lease property. Landlord-tenant law deals with elements of real
property and contract law. It is therefore, important for tenants to ensure that they have a written
agreement with their landlords in case any of them breaches the contract you will have a cause in
law.
The landlord-tenant relationship exists where there is a leasehold property. In the past
especially in the United States the landlords’ obligation was only to grant the estate to the tenant.
However, that has changed the landlord is now being charged with more obligations. This is after
the development of law to ensure that the tenants and landlords are more protected and ensure
that the rights of either are respected. In America landlord-tenant law has been codified in the
Uniform Residential Landlord and Tenant Act.
The landlord-tenant law has placed a number of duties to the landlord which he must perform
without breaching the contract. One of these duties that a landlord must perform is to deliver
possession of the property to the tenant at the beginning of the lease. The landlord is charged
with this responsibility to reduce the chances of wrongful holdovers. Apart from that the landlord
is also supposed to ensure that the tenant enjoys the property free from any nuisance and noise.
The tenant should have quite enjoyment of the property that he has leased.
The tenant can on the other hand be evicted due to failure of paying rent. However, he must be
served with a notice of eviction. The tenant should also protect the property and ensure that it is
in a good and habitable condition. The landlord-tenant law has provisions to protect both the
landlord and tenant and provides remedies which they can resort to in the event of breach of the
agreement.
